NOTABLE CASES
Recently, Ray Hertz argued before Maryland's highest court, the Court of Appeals, on the
issue of "When can an out of state Lawyer practice law in Maryland". If we win, the decision will
set higher standards for the legal representation of Maryland residents.
Ray Hertz settled a products liability case involving a defective door latch that failed and caused
our client to be ejected from the car. The manufacturer refused all liabiliy for the accident but
finally agreed to a six figure settlement one week before trial.
Jim McElwaine settled a slip and fall against an internationally known fast food chain. The
restaurant had an employee mopping the floor during the lunch rush and failed to place warning
signs in the area.
Ray Hertz settled an uninsured motorist case against GEICO.
The DC office of Workers Compensation awarded our client compensation for injuries suffered
during the Blizzard of 96. The insurance company refused any payment saying the client never
advised the employer of the fall, despite the fact that our client's supervisor saw the fall.
The firm was successful in representing a client before a Superior
Court jury, who fell in a service station in Washington D.C. obtaining a
verdict more that 5 times the last offer. This case was unusual as the
revolved around issues of the duty of Service Stations Dealers and the
oil company for repair. Mr. Hertz, has considerable experience in this
area as he was employed by Shell Oil Company and was able to use his
experience to prosecute the case.
In another Superior Court Case the firm successfully prosecuted a case
where the Defendant (represented by Allstate) failed to appear because
he was convicted of espionage against the United States. The jury
awarded more that 3 times the last offer, dispite the defendant's expert
testimony that the Plaintiff was injured in the accident..
